Because physical exercise can be strenuous and subject to risk of serious injury, Wellness Pros Gym urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You (each client, guest, and all participating family members) agree that if you engage in any physical exercise or wellness services; which include massage, chiropractic, reiki, ART or Tui Na or use any gym equipment on the premises or off premises including virtual training or at home training, involves inherent risks, including but not limited to, death, serious neck and spinal injuries resulting in complete or partial paralysis, heart attacks, and injury to bones, joints, or muscles. You agree that you are voluntarily participating in any of these activities and assume all the risk of injury, illness or death. Any recommendations for changes in diet, including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility, and you should consult a physician prior to undergoing any dietary or food supplement changes. 

This waiver and release of liability includes, without limitation, all injuries which may occur as a result of: 1) your use of all amenities, wellness services and equipment in the facility and your participation in any activity, class, program, personal training or instruction;, 2) the sudden and unforeseen malfunctioning of any equipment; 3) our instruction, training, services, supervision, or dietary recommendations; 4) your slipping and/or falling while in the building, or on the premises, including adjacent sidewalks and parking areas; 5) contact with other participants; 6) the effects of the weather, including high heat and/or humidity; and all other such risks being known and appreciated by Wellness Pros Gym. 

I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in any physical activity or wellness services. I/We acknowledge that I am physically fit and mentally capable of performing the physical activity or wellness services I choose to participate in. 

I/We grant and authorize the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or video taken of me/we to be used in and/or for legally promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, social networking sites and other print and digital communications, without payment or any other consideration. This extends to all languages, media, formats and markets now known or hereafter devised. This authorization shall continue indefinitely, unless I otherwise revoke said authorizing in writing.

I understand that this RELEASE, WAIVER AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as permitted by the laws of the state and agree that if any portion is held invalid, the remainder of the waiver will continue in full legal force and effect. You agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the Wellness Professionals Gym LLC, Nicholas Jung DC, Ready Ex Go Fitness (Jose Miguel Lopez) and the  facility for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of the facility, its agents, and employees. I have read this form and fully understand that by signing this form, I am giving up legal rights and remedies that I might have now or in the future. “I understand that my information will be kept secure and in confidence. The information contained herein shall be used for the sole purpose of assisting the staff in the evaluation of my safety for participation. External disclosures of this information will be limited to valid legal requests by law enforcement authorities and government agencies, legal proceedings where disclosure is necessary to protect the interest of Wellness Pros Gym in subpoenas and similar legal process.”
